Family

Mr. Islam is an expert in family law, handling all aspects of the field with a deep understanding of both procedural and substantive laws. He represents clients, whether applicants or respondents, in child arrangement cases, prohibited steps orders, non-molestation orders, specific issue orders and financial remedy proceedings.

During a fact-finding or final hearing, Mr Islam prides himself on conducting a robust cross-examination. He aims to undermine the credibility of false allegations and uncover the truth. His upbringing overseas has given him a unique advantage, allowing him to easily understand the cultural backgrounds of the parties involved in these proceedings.

At the final hearing of the child arrangement proceedings, Mr Islam, acting as the expert, cross-examines the Cafcass officer or social worker who authored the section 7 report. During his questioning, he effectively exposes the bias present in the report, which recommends no direct contact or limited contact. His closing submissions in such hearings are always compelling, grounded in leading case law to support his arguments.

When it comes to financial remedy hearings under the Matrimonial Causes Act 1973 or TOLATA 1996 following divorce or the end of a relationship, Mr Islam guides his clients through every step - the FDA, FDR and the final hearing. His focus is always on securing the best possible outcome for his clients, ensuring their expectations are met. Mr Islam has deep knowledge of claims between cohabiting partners, trust claims involving third parties (typically parents) and claims of intervenors.

Of course, in both child arrangement and financial remedy proceedings, Mr Islam strives to reach a settlement whenever possible. He prioritises amicable, friendly discussions before the hearing to minimise legal costs for all parties.

Mr Islam provides his services for a reasonable fixed fee.

Immigration

Mr. Islam has been representing clients at immigration tribunals (both first and upper tiers) since 2008, working on behalf of many solicitor firms. His advocacy is robust and highly effective, consistently presenting his skeleton argument in advance of each hearing, resulting in numerous appeals being allowed on the spot.

He takes instructions for all types of applications, including leave to remain, leave to enter, Indefinite Leave to Remain (ILR), and more, submitting them to the Home Office and Entry Clearance Officers. His covering letters are always persuasive, citing leading case law, which often leads to successful outcomes at the first instance. Mr. Islam has successfully secured remedies for clients in complex immigration, asylum, human rights, and nationality matters through well-crafted presentations.

Given the frequent changes in immigration law, Mr. Islam understands the importance of staying up to date. In 2015/2016, when thousands of students living lawfully and hoping for settlement under the ten-year lawful residence grounds were at risk of breaching 3C leave due to the Immigration Act 2014 (which removed in-country appeal rights for points-based migrants), Mr. Islam's diligent research saved many students. His extensive investigation uncovered immigration rules (SET-O applications route), which later became a practice followed by other practitioners.
